Terms and conditions

1 Guarantee of authenticity
The photographs of Galerie 1 2 3 are original works whose authenticity is certified. Each photograph is accompanied by its own certificate of authenticity (IVPDA standards).


2 Description
2.1 Condition
The following international codes are used to describe the condition of our photographs:
A+/ A / A- / B+ / B / B- / C / D

2.2 Size of the photographs
The size is indicated approximately in both centimetres and inches, height x width, with a precision of +/- 1 cm (0.4 inches).

2.3 Overview of the photographs on the website
The quality, colour and definition of the images published in the photo123 website may change, depending on the hardware, screen settings, software, or other factors.

2.4 Liability
Description of the photographs is made as accurately as possible and to the best of our knowledge. Galerie 1 2 3 cannot be held liable for omissions or errors in the condition report.


3 Shipment

3.1 Shipping within Switzerland.
Shipping by Swiss Post is free of charge within Switzerland.

Packaging is also free and your purchases are insured until delivery at your door.

3.2 International shipment to more than 50 countries

Taxes, VAT, customs declaration costs and other import fees are to be paid by the buyer.

You have the choice between:
- Fedex (with tracking number, free insurance and rapid delivery);
- Swiss Post (no tracking, no insurance and no guarantee of delivery time).


All our photographs are shipped within 10 days in reinforced packaging, together with their certificate, invoice and customs documents.

You will also receive a shipment notice (Swiss Post) or a tracking number (Fedex).


4 Insurance
When shipping by Fedex, Galerie 1 2 3 insures photographs until delivery. In case of damage due to transportation, the buyer must immediately contact Galerie 1 2 3 and report any concern related to the parcel.


5 Custom Fees & Taxes
To ensure proper custom clearance, Galerie 1 2 3 draws up all the usual documents that are necessary for the customs. Custom fees, importation taxes (such as VAT paid in the destination country) are collected by customs via the courier and are to be paid by the buyer.
Galerie 1 2 3 is not responsible for any delays due to custom controls and/or the payment of theses taxes.

European Economic Area (EEA)
As Switzerland is not part of the EEA, EEA countries importations tax (VAT) will be applied according to the custom regulations of each EEA country.

United Kingdom
United Kingdom customs will usually tax imports of works of art (original, pre-1973) at 5% of the value of the work. Gallery 1 2 3 will issue a declaration to this effect.

Please note that VAT and any handling fees, customs/import duties and taxes are to be paid by the buyer.

USA

The United States customs do not impose a tax on imported artworks.
US customs will ask the customer (the importer) to provide his registration/identification number for clearance, like his Social Security Number or his Federal Identification Number (SSN / FIN / GST / RFC) in application of the Homeland Security Act. For a value over US$ 2’500, the customs dept will ask to complete a form provided directly by Fedex. For example, Fedex apply a clearance fee of about US$ 35, charged to the customer.
Individual states may apply the local state tax.
Any tax is to be paid by the buyer.


6 Sale and cancellation
The online payment is a finalised contract of sale. The amount paid remains due.
A cancellation can be requested by the customer who argues that there has been an error within 24 hours of payment. The Gallery has the freedom to refuse or accept the cancellation of the order, if the shipment is not yet effective, and only in this case. The Gallery will make a refund to the customer's card, after deduction of the credit card collection fees (3.5%) and deduction of the administrative costs incurred (maximum CHF 100.-). In extreme cases, a compensation for loss of offer and sales opportunity may be retained, e.g. immediately after a newsletter or at the launch of an exhibition.


7 Return Policy
In case you are not satisfied by your purchase, you have the right to return it in exchange of a merchandise credit (the value of the purchase less the expenses, i.e. return packing fee, credit card fee, VAT, etc.).

If there is proof of a discrepancy between the condition report and the actual condition, Galerie 1 2 3 will pay for any additional fees. In any case, the buyer must inform Galerie 1 2 3 of any anomalies within 3 days of having received the purchase in order to return it.

8 E-mail & newsletter
Each online buyer must give an e-mail address to complete a transaction and to ensure follow-up until delivery. By doing so, the buyer agrees to receive our newsletter. It is possible to unsubscribe from the newsletter at any time with a simple click.


9 Privacy policy
All personal details are treated in strict confidentiality and are not transmitted to a third party.


10 Accepting terms and conditions
All transactions are governed by the present terms and conditions and imply their enforcement.
